TIER2

If you are looking for fulltime job after finishing your study, the best way for students is getting TIER2 visa, depending to academic situation of the students and will lead to permanent residence after 5 years.

If you intend to convert your TIER4 visa to TIER2, you should have one of the following certificates:

England Home office permits the students who have academic visas to work while studying in England but states in its academic regulations:

The main objective of academic visa is that you come to England to study; but you are allowed to work there in order to get income while study.

According to Britain immigration regulations you are allowed to work lawfully, but should consider the following limitations:

  • Maximum 20 hour work with or without wage in a weak during a semester for higher education students
  • Maximum 10 hour work with or without wage in a weak during a semester for students of English centers
  • Full time work during holidays is permitted

  • Self-employment is not permitted (including independent work or counsellorship or initiating your own business, even if you are not major stockholder)
  • You are not allowed to work as a professional in sport field (such as sport coach) or entertainment.

Review your BRP to be sure about work conditions. If you believe that Home Office has made mistake (such as mentioning work prohibition in BRP), and till the time you haven’t corrected your immigration permit, you won’t be able to work 20 hours a week.

Short term student visa

It is not allowed to work according to short term student visa.

When is holiday?

All students are allowed to work full time during Christmas and Easter holidays, because these holidays are not considered as part of academic semester.

If you are 12 or 24 months master’s degree student, the time determined for composing your thesis, to the time the academic course is formally finished in CAS, is not considered as holidays and you are treated as a university student who is writing his thesis.

The academic group may give you a four weeks holiday to finish your thesis. During this time, you are allowed to work full time. Before initiating your full time work in England, you should submit your holiday request confirmation to registry office; without this request you are not allowed to have a full time job; it is not issued retroactively. Registry office will issue a letter to approve this holiday just if an email is sent from one of your education group personnel. Please pay attention that discontinuance of education due to holidays may not be used in revision request of board of directors’ decision.

If education group agrees with holiday before finishing your education, please ask them to send an email with the following information:

  • Your name and family name
  • LSE no. of your identity card
  • The date that your holidays, that they have agreed with, ends (it shouldn’t last more than four weeks).

Any full time job during the time considered for completing you thesis, is regarded as breach of your academic visa. As supporter of academic visa, LSE as part of agreement of our support license for reporting any breach of visa requirements is legally requested. You should carefully think about long term consequences of breaching your work conditions before any imprudence.

What does master’s/ PhD academic semester means?

Holidays for all registered students of complementary studies are Christmas and Easter. By the way, during holidays, summer is considered as your education continuance. Master’s/ PhD students are not allowed to have a full time job during summer.

Academic semester of Master’s/ PhD students

PhD students may not have summer holidays and are not allowed to request for holidays during their academic semester. It is possible to submit your holiday request during summer, but it is recommended to talk to PhD association in this regard.

Is the student allowed to work voluntarily?

There is a legal distinction between voluntary work and paid/ unpaid jobs. By the way, definitions are complex and in order to prevent from any difficulty, we should consider voluntary work as part time job and shouldn’t work voluntarily more than 20 hours in each 7-days period. If you have part time job, you should be careful that the time spent for voluntarily works/ paid jobs is not more than 20 hours.

Is the student allowed to work for more than one employer?

You are permitted to have several contracts, but during a semester, you are not allowed to work more than 20 hours paid/ unpaid job in a week. This means totally 20 hours and not 20 hours for each employer.

You and your employer are responsible to be sure that you don’t work more than 20 hours in a week. If you believe that your contracts may expose you to the risk of working more than allowed hours, you should inform your employers as soon as possible. This issue is not regarded retroactive, because the report for working more than allowed hours has been registered for you.

PhD students with several contracts

PhD students are recommended to supervise their working hours, especially if they have several jobs. For instance, if you are working as a head secretary in a dormitory, you should make sure that your other job doesn’t breach the rule of 20 hours’ allowed work in a week according to academic regulations.

The formal date of study for PhD students may change depending on requirement to extend visa in order to do some amendments. Please make sure that you may have full time cooperation with our team, before registration.

Is it possible to work during the time I have requested to extend my academic visa?

If you submit your request for extending academic visa in England, before your former visa has expired, your academic visa conditions will be continued to the time that decision about your request is declared.

If your employer asks for documents suggesting that your request for academic visa is being reviewed, you may submit the following documents:

  • The envelope indicating that you have presented a request
  • Letter of introduction from UKVI in relation to your request
  • The Letter approving issuance of academic visa and granting BRP to you

You should inform your employer about your request and provide him your new BRP as soon as you have received it.

What will happen if you breach the rule?

If you work without permission or have a prohibited job, you have committed immigration crime with following consequences:

  • Being summoned to the court
  • Paying fine to 5000 pounds
  • Imprisonment to six months
  • Deportation
  • Prohibition from returning to England from one to 10 years and requirement of declaring this prohibition and illegal work in your later requests for immigration to England and other countries in the future.

You should consider the long term effects of illegal employment on your future conditions before breaching law.

Home Office makes academic visa supporters obliged to report violation of requirements, such as illegal work. If LSE finds that you are working illegally, we should report it to Home Office, otherwise our supporting license will be at risk.

How should I prove the employer that I am permitted to work?

Your visa is the best document for proving your permission to work in Britain. Employers willing to employ students should make sure that the student is permitted to work in England. Home Office regards the following cases as acceptable evidences:
